By shipping your materials to Phoenix Refining (“Company”), you agree to be bound by these Terms and Conditions (“Agreement”) and the Privacy Policy incorporated by reference. This Agreement governs the relationship between you, the customer, and Phoenix Refining, its successors, and assigns. Failure to provide this information will delay the processing of your materials and issuance of payment. If we do not receive the required information or a return request within 30 days, your materials may be retained as compensation for processing.

Phoenix Refining does not offer insurance coverage for materials shipped to our facility However, we reserve the right to reject any damaged or tampered packages, and we will return them to you via the post office. We will not be responsible for any lost or missing materials of any kind.
Materials shipped with USPS Delivery Confirmation are not insured unless USPS confirms receipt of the package at our facility in Cleveland, Texas.
When using USPS for shipping, we highly recommend opting for Registered Mail to ensure the highest level of security for your package. It’s crucial to confirm that your package is scanned into the USPS system to verify its delivery. Additionally, it's important to include a complete inventory list with your shipment. If your package arrives and any items are missing, please note that we will not be held responsible for any losses that were not documented in the inventory.
At Phoenix Refining, we conduct thorough and precise testing to evaluate the precious metal content of the materials that you submit. By sending your materials to Phoenix Refining, you agree to the following terms regarding the testing, handling, and disposal of your samples:
6.1. Purpose of Testing
The testing conducted is designed to assess the value of your materials specifically for recovery and recycling purposes. Through the assaying process, we will determine the precious metal content based on its purity and composition. It is important to note that this service is not offered for free appraisal. Additionally, materials that are submitted are assumed to be intended for sale or recycling rather than solely for free testing. Therefore, Phoenix Refining reserves the right to charge for assaying services if the materials are submitted merely for appraisal without any intention to sell.
6.2. Handling of Samples
When preparing your shipment, it is essential to include a complete and accurate inventory list. Phoenix Refining will not be held responsible for any items that are lost or missing if they were not included in your inventory. Once your materials are received, they will undergo a precise assaying process to determine the presence and quantity of precious metals. This assessment will utilize state-of-the-art technology, ensuring that the results are as accurate as possible.
6.3. Turnaround Time for Assays
Phoenix Refining aims to complete the assaying process within 2–3 weeks of receiving your samples. This timeframe may vary depending on the complexity of the materials, the volume of samples received, or other operational factors. Customers will be notified promptly upon completion of the assay, and any significant delays will be communicated as necessary. While we strive to meet this timeframe, Phoenix Refining cannot guarantee specific completion dates and is not liable for delays caused by circumstances beyond our reasonable control.
6.4. Eligibility for Free Assessments
To be eligible for free assessment of your materials, you must complete the shipping form correctly and provide the necessary information. Any submission missing required details or the proper inventory may result in ineligibility for the free assessment. Phoenix Refining reserves the right to charge for assaying services if the shipping form is incomplete or inaccurate.
6.5. Outcomes of Testing
Phoenix Refining adopts a strict policy regarding the handling, evaluation, and disposal of submitted samples. Once samples are received, they are processed for assaying and evaluation to determine the presence of valuable materials. If the testing identifies valuable metals in your submission, Phoenix Refining will extend a formal purchase offer to acquire the remaining inventory. The offer will be based on the current market value of the precious metals detected in the samples. However, it is important to note that even if valuable materials are found, the submitted samples will not be returned to you under any circumstances.
In the event that no valuable materials are identified, Phoenix Refining will proceed with the proper disposal of the samples. Non-valuable samples will be securely discarded as part of the company’s annual disposal process, which takes place at the end of the year.
This policy ensures that all materials are handled efficiently and in compliance with the company’s established procedures. By submitting materials to Phoenix Refining, you agree to these terms, including the non-return policy for all samples, regardless of their assessed value.
6.6. Disposal of Materials
At the end of the year, all samples that have been submitted and are deemed non-valuable after testing, or those for which no purchase agreement is reached, will be disposed of. Phoenix Refining takes environmental responsibility seriously in this process, adhering to environmentally responsible disposal practices that comply with all applicable regulations. Non-precious materials are disposed of in a manner that meets local, state, and federal environmental standards.
6.7. Protection Against Abuse
Phoenix Refining takes significant measures to prevent the abuse of our assaying process. We will not return samples solely for the purpose of free testing. Any attempt to manipulate our system for free appraisals or sample returns will be taken seriously and could lead to the termination of service, potentially resulting in legal action. We reserve the right to refuse service to any customers who are found attempting to exploit the testing process. This policy specifically targets those who send materials with the sole intention of obtaining free assaying without a genuine desire to proceed with selling or recycling the material.
6.8. Agreement to Terms
By submitting materials to Phoenix Refining, you acknowledge and accept that all samples, whether valuable or non-valuable, will not be returned to you and will either be purchased by Phoenix Refining or disposed of at the end of the year. You also agree to the terms outlined in this section, confirming that you have read, understood, and accepted these conditions regarding the handling and disposal of your materials.
By accepting these Terms and Conditions and sending your materials to Phoenix Refining, you explicitly agree to waive any and all rights to litigate, sue, or bring legal action against Phoenix Refining, its employees, officers, successors, and assigns, for any claims, disputes, or losses related to the materials you have submitted.

7.1. Arbitration Agreement
In the event of a dispute, you agree to submit to binding arbitration in Cleveland, Texas, as the exclusive method of resolving disputes. The arbitration will be conducted under the rules of the American Arbitration Association (AAA) and will be binding on both parties.
7.2. Agreement to Terms
By shipping materials to Phoenix Refining, you confirm that you have read, understood, and accepted this waiver of litigation rights. You acknowledge that you are voluntarily relinquishing your right to sue or pursue legal action in any court of law regarding the materials sent to Phoenix Refining.
By providing your contact information, you consent to receive marketing emails from Phoenix Refining regarding products and services we believe may interest you. If you prefer not to receive such emails, you may opt-out via the unsubscribe link in the email or by contacting us directly.
This Agreement is governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the state or federal courts located in Cleveland, Texas. You agree to reimburse us for any costs incurred in defending such disputes outside of Texas, including attorney's fees, except for cases regarding injunctive relief for breaches of this Agreement.
Customers are permitted to submit only one claim per household. Any multiple claims will be denied. Additionally, it is required that you provide a sworn statement concerning the ownership and value of the materials being shipped to us. Keep in mind that failure to comply with this requirement could delay the processing of your claim or, in some cases, may result in the loss of your materials as compensation for processing.
Phoenix Refining reserves the right to terminate or suspend services to any customer at any time, for any reason, at its sole discretion. If we determine that you have violated these Terms and Conditions, we may refuse to process any future transactions.
